The federal Environmental Protection Agency has fined New Haven-based Active Oil Inc. $42,075 for illegally storing waste oil contaminated with PCBs in its receiving tanks, a case dating back to 2003. Federal law requires that the storage and handling of polychlorinated biphenyls, which are potential carcinogens, be regulated and shipments of oil be tested for the existence of such contaminants. While the entire facility was contaminated, EPA attorney Gregory Dain does not believe workers were exposed to the PCBs or the environment was harmed. Active Oil is back in operation after a period of inactivity and has not yet paid the fine. In 2004, Active Oil sued an environmental testing firm that had been hired to test oil shipments for the company. Active Oil continues to be held responsible until further notice of the suit, which was settled in early January.
